Right to Privacy: Delhi HC seeks Centre’s stand on PIL against surveillance systems.

On Wednesday 2nd December 2020, the Delhi High Court had asked for a reply from the Center regarding violation of the right to privacy by implementing various surveillance systems like Centralized Monitoring System, Network Traffic Analysis etc. Chief Justice D.N. Patel and Justice Prateek Jalan were hearing a plea that was filed by an NGO. The Court had issued notices to the ministries of Home Affairs, Information Technology, and Communications and Law and Justice asking for a reply regarding this particular plea.

According to the plea, the Center for Public Interest Litigation (CPIL) has argued that such surveillance devices allow Central and State law enforcement authorities to intercept and control all large-scale telecommunications, and that is an infringement of the constitutional right to privacy of individuals.

The NGO in this particular plea had asked for direction from the Court to the Center, to stop these surveillance operations, which are conducted by CMS, NETRA etc that allow an analysis of personal data, as this violates right to privacy. The particular petition had also asked for direction in establishing a permanent autonomous supervisory body, consisting of judicial and legislative body for issuing and verifying lawful interception and also supervising orders or warrants under the provision of Indian Telegraph Act, 1885, and Information Technology Act, 2000.

The Court has listed the matter for the next hearing which will take place on 7th January 2021.
