Punjab High Court: Retirees cannot assert the Right to Official Housing after Retirement

On 19th of June, 2020, Friday, the High Court of Punjab and Haryana stated that the employer is providing accommodation in such a way as to make it convenient for its employees to work and that the employee cannot claim any rights in the official accommodation, especially if he/she is no longer in service.

The High Court of Punjab has dismissed the plea of a former staff member of the University of Punjab who had submitted that his retirement fees had not been paid and, therefore, he could not be directed to hand over the vacant possession of the accommodation given to him while in service.

In August 2018, when he did not leave the premises until September 2019, the university released a notice of expulsion of the same or face-to-face eviction proceedings. University had told the court that the petitioner himself was guilty because he did not submit “No Due Certificates” from the estate cell and the rent recovery cell. “The total retiral due fees to which the petitioner is entitled is INR 21,97,01/-, whereas his liabilities, including the various attachment orders passed by the executing courts, are equal to INR 39,36,980/-,” the court said, adding that he was entitled to stay for a period of three months after his retirement.

The court dismissing the plea, observed that the petitioner has failed to come forward with a rule or instructions authorizing the retired employee to withhold possession of the official accommodation in the absence of a settlement of the retiral due fees.
