Plea in SC seeks that there will be no freedom of speech and expression with regard to pending matters in court except fair and true reporting

A PIL has been moved in the SC which seeks a declaration stating that there shall be no freedom of speech and expression with regard to pending matters before the courts except to the extent of fair and true reporting.

The petitioner i.e. Advocate Dr. Subhash Vijayran, has contended that the courts have become punching bags for some advocates. These advocates approach the court and when the judgment is not in their favor or they are not satisfied with it, then they start blaming the judges and the court through certain media channels.

To that regard it is stated that, “Criticizing the judgments on points of law is healthy criticism – a sign of mature democracy – and helps develop the law. But criticizing the court/ judges in a way that either impute motives on the judges or project them as biased, is not healthy.”

The PIL also focuses on Congress leader P. Chidambaram who recently has posted some tweets allegedly attributing bias towards the judges with regard to the Rajasthan political crisis which is still pending before the court of law.

Dr. Vijayran has stated in his plea that these acts associate judges of the Supreme Court and the High Court as the “puppets” of the government at the centre. It also implies that judges will give favorable decisions to please the government in power.

Such actions put a black spot on the judiciary and at the same time it lessens the faith of the public with regard to the system. In that regard it is stated, “If anyone has any grievance, he has the right to move the courts through appropriate proceedings. Ranting out in the media and imputing motives/bias on the judges is neither good for the system nor is the solution to the grievances of the aggrieved.
