Plea in Delhi HC seeks release of foreign nationals relating to the Markaz incident who are still in quarantine despite testing Covid-19 negative

A petition has been filed in the Delhi High Court seeking release of 916 foreign nationals who were in the Nizamuddin Markaz for a religious congregation and have been held in institutional quarantine since 30 March despite being screened as negative for COVID-19.

The petition, which is likely to come up for hearing on Friday, challenged a May 9 order from the Revenue Department of Delhi Government, which had directed  to hand over 567 foreign nationals, currently held in institutional quarantine to the custody of Delhi Police, despite being tested negative for Covid-19.

The said petition is filed by Advocate Ashima Mandla, which is challenging the said move by finding it stripped of any validity and being violative of Articles 14, 21 and 22 of the Constitution.

Although asking the court to grant a writ of habeas corpus to free those foreign nationals immediately, the petitioner argues that, “Even otherwise, the mere act of detaining 916 foreign nationals in institutional quarantine for over a month, despite all 916 persons now testing negative for Covid-19 shall tantamount to illegal detention and violating Articles 14, 21 and 22 of the Constitution.”

The petitioner stated the on-going month of Ramadan as a matter of urgency and claims that holding these foreign nationals in quarantine isolation will lead to a violation of their constitutional rights since Eid is just a few days away.

The Petitioner has therefore requested the court to direct the government of Delhi to direct and allow the immediate release of foreign nationals held in institutional quarantine in Delhi, having tested negative for covid-19 as quarantine in perpetuity is equal to illegal detention.
