Plea dismissed by Delhi High Court which was challenging Delhi Govt’s compensation scheme for Delhi Riots victims

New Delhi: On Wednesday (4th March 2020) the Delhi High Court dismissed a petition challenging the compensation declared last week by the AAP government for victims of the riots in northeast Delhi.

A Bench comprising of Chief Justice D N Patel and Justice C Hari Shankar was hearing the matter and stated that, “it is a policy decision and the court won’t interfere in it".

The plea was moved by Advocate Shashank Deo Sudhi who contended that, the announcement by the Delhi Govt granting compensation to victims, was arbitrary and unreasonable.

He further argued that it would be a complex task to identify the real victims of the horrific incident. At the same time it would give an opportunity to some people to falsely claim the compensation and hence resulting in wastage of public money.

While announcing its decision, the court stated that that it expects the Delhi Govt to give assistance to only the real victims of the riots and also further stated that the perpetrators must not be awarded any compensation for the wrongs committed by them.

"The compensation is being awarded on a no fault basis. There is nothing wrong with it," the court said. It also asked the Delhi government to ensure that compensation is paid only to the victims of the riots.
