PIL FILED IN SUPREME COURT CHALLENGING THE IRREGULARITIES IN PROCEDURES ADOPTED FOR DESIGNATION OF SENIOR ADVOCATES

A PIL is filed in the Apex Court. The PIL challenges the inconsistent various methods of appointing Senior Advocates.

For instance, in Bombay High Court, the requirement is that the advocate must have experience of minimum 10 years for being eligible for designation as Senior Advocate. On the other hand, Delhi High Court require the same period of experience but in subordinate Courts. Himachal Pradesh High Court, Allahabad High Court, Patna High Court etc. require the advocate to disclose their income. In Jammu and Kashmir and Rajasthan High Court, it is required that the age of the advocate must be between 35-40 years for being designated as Senior Advocate.

These diverse methods of designating an advocate as a senior advocate has been strongly opposed in the petition filed by Ashwini Upadhyay, who is a BJP leader also along with being an advocate. He has pointed out that there is no standard period of experience for this and different Courts have different guidelines on the same. Thus, the PIL sought a set period of practice for the lawyers to be designated as Senior Advocates.
