PIL dismissed by the SC challenging the rise in the prices of Petrol and Diesel in spite of low crude oil prices

A PIL was dismissed by the Supreme Court on Tuesday challenging the rising prices of petrol and diesel. The bench headed by Justice Rohinton Fali Nariman expressed reluctance to hear the matter.

After sensing the mood of the court with regard to this plea, the petitioner decided to withdraw the petition as he was warned of heavy costs being imposed on him if he decides to further argue the matter.

In this regard Justice Nariman had told the petitioner, "Do you really want to argue this case? Because we will impose heavy costs if you do".

The said plea was seeking directions for the benefits of low crude oil prices be passed onto the final consumers. It has also contended that despite the low international prices of crude oil, companies have continuously raised the prices of petrol and diesel.

This was stated due to the fact that petrol prices have increased by approximately Rs. 8.3 per litre whereas diesel has seen an increment of Rs. 9.4 per litre in June 2020 itself.

Disinclination of the court towards this plea was due to the reason that through established precedents, courts generally refrain from exercising their power of judicial review over economic policy decisions as it is believed that they fall within the domain of executive.
