PERSONS ACCUSED OF 1984 ANTI SIKH RIOTS ACQUITTED BY SUPREME COURT

Ganeshan and other 6 accused persons were convicted by Delhi High Court under Sections 147, 188 and 436 of the Indian Penal Code. Much reliance was placed on the evidences submitted to the Court.

However, in appeal, the Supreme Court has observed that those witnesses who are present with a curious intention and not having the set objective are not guilty.

The bench comprising of Chief Justice Ranjan Gogoi, Justice Deepak Gupta and Justice Sanjiv Khanna held that the Courts usually focus on at least two witnesses who can take a genuine vow that the accused was involved in illegal activities such as looting, dacoity etc. As in the present case, none of the witnesses had deposed that they had seen the accused persons getting involved in the unlawful acts.

Thus, the Supreme Court the accused persons, seven in number, were acquitted as no proper evidences were produced to substantiate their involvement in the 1984 Anti Sikh riots.
