Permission to medically terminate 23 week old pregnancy of a 12 year old rape survivor- Bombay HC

A petition was filed by the mother of a 12 year old girl, who was raped by some people in her neighbourhood, seeking direction of medical termination of pregnancy. On June 5 the mother of the rape victim lodged a complaint at Sangli Police Station and she approached a government hospital for pregnancy termination of her minor child but the hospital could not terminate the pregnancy without the permission of the Court as it had crossed the 20 weeks limit according to the Medical Termination Pregnant Act, 1971.

Honourable High Court directed the Government hospital to examine the 12 year old minor girl. The Government hospital that is the Government Medical College of Miraj, Maharashtra recommended that if pregnancy is permitted to continue, it would have significant implications for the physical and mental health of the minor girl and will thus be permitted to terminate the pregnancy.

On July 6 the High Court accepted the recommendation of the hospital and advised the mother to take her 12 year minor to the hospital where the pregnancy will be medically terminated for the child.
