P&H HC Condemns Police for Using A Derogatory Word For An African National Accused In A Criminal Case Under NDPS Act

On June 15, 2020 Punjab and Haryana High Court gave a judgment regarding the use of scornful words against an African National by the police officials. The Court decided that such words are very harmful as well as disrespectful and should not be used by the police officials in a criminal case under The Narcotic Drugs and Psychotropic Substances Act, 1985.  

Justice Rajiv Narain Raina strictly excoriates the act of Punjab and Haryana Police and said “this is a highly offensive word across the globe and no one has any business to use it, and much less the police. Hence, it is directed never to use the unprintable word in any police document including in challans or anywhere else on case papers including in investigation reports. This brings shame to India and hatred for the country. The police appears to have assumed that every black is a drug peddler and should be treated as such. This is terrible thinking”.

The Court also advised the Director General of Police, Punjab, to consider the whole issue and to advise the Police force, in this regard, that they should never use any kind of derogatory words such as ‘nigro’ or ‘negro’ when referring to any black person in case papers.  The African Nationals those who are temporarily living in our country as students or visitors must have the right to get respect and dignity.

The investigating officers and police officials were also directed that at the time of registering FIR, no person should be judged on the basis of the colour of his/her skin.

The Court also held that a strict action must be brought against the policemen who will entertain this kind of character assassination based on the colour and shape of the body and the investigation must be non-aggressive in the search for truth and commission of cognizable offence.
