No petition can be transferred from one court to another on the single basis of delay in disposing: SC

New Delhi:The Supreme Court of India has observed that no petition can be transferred from one court to another on the sole basis of delay in disposing,

The petitioner prays before the Supreme Court of India to transfer the writ appeal logded in Telangana High Court to the High Court of Delhi. The issue involved in the writ appeal concerns land acquisition proceedings, and the petitioner's counsel argued before the court that the petitioners had lost everything and that, despite his best efforts, the High Court of Hyderabad could not have taken the case for final disposal.

The prayerwas deemed to be 'very strange' by Justice V. Ramasubramanian. The judge denied the appeal and noted:

"Every court has its own limitations. Therefore, no petition can be transferred from one court to another on the sole ground of delay in disposal."

In its order, the Court held that the grounds for the petitioners seeking the transfer could not be accepted. Each court has its own limitations. Consequently, no petition may be transferred from one court to another on the sole ground of a delay in disposal.
