Nagpur Lawyer Alleges Maharashtra CM Suppressed Facts in Nomination Papers, Sessions Court Issues Notice to CM

The Nagpur Sessions Court has issued notice to Maharashtra Chief Minister Devendra Fadnavis in a criminal revision application filed by a Nagpur lawyer.

The lawyer, Satish Uke, in his application has alleged that the Maharashtra CM suppressed facts about pending criminal cases against him while filing his nomination papers prior to 2009 state assembly polls.

Satish Uke had filed a criminal application against Fadnavis, earlier in 2014, before the Additional Chief Judicial Magistrate (ACJM) in Nagpur alleging that the Maharashtra CM had ‘misled the people’ by hiding information about two pending criminal cases in the affidavit submitted along with his nomination papers.

The ACJM, however, had rejected the application filed by Uke.

Following this, Uke filed a criminal revision application in the Sessions Court, saying that the CM is one of the accused in a case under Sections 218, 220, 217, 425, 466, 467, 420, 468, 469, 474, 471, 109, 506B read with Section 34 of the IPC and a case under Section 500 of the IPC.

The Additional Sessions judge then issued a notice to Fadnavis, however, a dispute erupted over the order passed as there was confusion whether the issuance of the notice was to the non-applicant in the case i.e., Fadnavis, or to the Police Station Officer (PSO).

Satish Uke then filed a petition challenging the order in the Nagpur High Court and sought the criminal revision application to be considered once again.   

In an order dated February 18, 2015, Nagpur HC judge SB Shukre allowed the petitioner’s prayer and directed the Sessions judge to hear the application afresh.

The Additional Sessions judge of Nagpur on Tuesday issued notice to Devendra Fadnavis in the case.
