MP High Court: Wife Has the Right to Know Husband’s Salary Details

"A woman is entitled to know husband’s salary details", the Madhya Pradesh High Court has observed.

The observation was made by a two-judge bench of HC comprising of Justices S.K. Seth and Nandita Dubey while hearing the petition of one Sunita Jain. The woman approached the High Court seeking higher maintenance from her estranged husband.

In her petition the woman alleged that her husband was drawing a high salary – being a senior officer with the State-run BSNL – while she was only provided with a monthly maintenance amounting to Rs 7000.

Ms Jain filed a “Right to Information” application to obtain her husband’s salary details when a trial court rejected her plea, stating that her husband produce his pay slip.

The matter reached the Central Information Commission (CIC), which ordered the BSNL Central Public Information Officer to disclose the required details – in an order dated July 27, 2007.

However, the CIC order was challenged by the petitioners’ husband before a single Bench of the M.P. High Court. The bench set aside the order passed by CIC on March 2015.

Following this, Ms. Jain moved the two-judge bench of the HC which observed that a wife was entitled to know her husband’s remuneration.

The bench in its order stated that the wife couldn’t be denied information regarding husband’s salary details by considering her a third party.

While setting aside the March 2015 order of the single judge bench, the two-judge bench of the M.P. High Court passed an order on May 15, allowing the writ appeal of Ms Jain and upheld the order of the CIC.
