Medical Admission Scam: Supreme Court sets up bench of 5 senior judges

The Supreme Court of India has referred to a five-judge constitution bench a plea seeking SIT probe into a retired Odisha High Court Judge’s alleged involvement in a scam involving an Uttar-Pradesh based medical institution that has cast its shadow on the functioning of the top court.

The former High Court judge was allegedly trying to help the Lucknow-based Prasad Educational Trust to overcome a bar on admitting students in its medical college for two academic years (2017-2018 and 2018-2019).

The bench of Justice J. Chelameswar and Justice S. Abdul Nazeer directed the CBI Director to keep the entire record of its investigations into the matter and the case diary in a sealed cover and place it before the constitution bench that will hear the matter on Monday.

The matter concerns the arrest of former Orissa HC judge I M Qudussi and others for allegedly helping a medical college in Uttar Pradesh, which was found by the Medical Council of India (MCI) to be deficient in infrastructure required to impart medical education, enrol fresh students on the strength of orders controversially passed by two judges of Allahabad HC's Lucknow bench. The two HC judges accepted a plea by the college to admit students despite an SC order specifically prohibiting subordinate courts from doing so.

Raising the matter, senior advocate Dushyan Dave said the CBI FIR narrating activities of retired Qudussi and alleged middlemen revealed their alleged deep nexus with judges of constitutional courts. [Inputs TOI]
