Malegaon blast case 2008: SC grants bail to Lt. Colonel Purohit after 9 long years

The Supreme Court on Monday granted bail to accused Lt. Colonel Shrikant Purohit after 9 years on 2008 Malegaon Blast Case on a petition challenging the Bombay HC’s verdict of dismissing his bail plea. His Advocate argued that Purohit suffered nine years of prison but the charges are still not been framed against him. 

Purohit moved to Apex Court after his petition been dismissed by Bombay High Court regarding his bail. The court sets aside the previous order and said the bail has granted on certain conditions. The conditions will be mentioned by the Court in the next hearing.

A bench Comprising Justices R K Agarwal and AM Sapre reserved the order last week and passed the bail on plea.     

Additional Solicitor General Maninder Singh representing the National Investigation Agency claimed that there was evidence against Purohit that would help in framing the charges. 

Senior Advocate Harish Salve, argued that the charges against Purohit have still not framed against him, despite the fact he suffered nine years of prison. He also claimed that charges against him and other 10, under the Maharashtra Control of Organized Crime Act (MCOCA), had wrongly applied and stated that he is entitled to getting bail.

The blast took place on September 29, 2008 in a communally sensitive textile town in Nashik District of Malegaon wherein the incident claimed the life of seven people.

Purohit also claimed to be a victim of “political dispute” and has been rotting in jail from 9 years.

The chart sheet in 2008 Malegaon Blast case consists 4000 pages, indicated it as a primary blast target due to Muslim majority in the area. The chart sheet alleged Purohit, Thakur and Swami Dayanand Pandey as the major plotters of the blast. However, Thakur in 2016 was given clean chit by the National Investigation Agency and Sadhvi Pragya granted relief in the case by Bombay High Court.
