Litigants Unable to Get Justice through Virtual Courts’: Bar Council of India to hold consultations on restoration of physical functioning of courts

Upon acknowledging that litigants are unable to seek justice through virtual courts, the Bar Council of India (BCI) on Wednesday has agreed to hold national consultations with lawyers and litigants on the resumption of routine hearings in all courts, which apparently has only dealing with urgent matters through video conferencing during the coronavirus-induced lockdown.

Bar council of India stated, “It will consult the senior and other advocates of Supreme Court and High Courts in order to gather their opinion regarding resumption of regular hearings in the Courts. On one hand cases of COVID-19 are increasing day by day and on the other, the problems of litigants and advocates are mounting.”

The BCI stated it had received complaints of following "pick and choose" methodology in fixing urgent issues in some high courts and frequent hearing disturbances during the video conferences due to unsatisfactory internet connection and other technical issues.

The council also shared opinions of various bar councils and senior lawyers across India and said, “some people are trying to take undue advantage of the lockdown (and almost closure of courts) and the legal profession is gradually being attempted to be high-jacked by a few blessed lawyers and select Law-Firms who have high connections".

BCI said that it would, if necessary, approach CJI and various chief justices of high courts and request them to make a note of the disturbances that are faced by lawyers in these times. It also contended that all the bar associations pass a resolution and send it through local Leaders such as MLAs and District Collectors to the Prime Minister and to all the Chief Ministers.

 The BCI further said it has decided to ask the Prime Minister and all the Chief Ministers to help, "needy lawyers to overcome their professional loss." It also highlighted the fact that, “unless the Government comes to their rescue, their problem is not going to be solved.”
