Letter Addressed To The CJI and Companion Hon’ble Judges of SC, Demanding High Court Monitored Investigation On The Hathras Brutality

A group of 47 lady Advocates taking notice on the brutality took place on September 14, addressed a letter to CJI SA Bobde hoping for urgent intervention that “We are writing to you out of much anguish and distress over the manner and procedure in which situation has been progressing with respect to the tragedy that struck a 19 year old dalit girl from Hathras, U.P.” Advocates prayed for ‘Constitution of a High Court monitored investigation and trial to ensure strictest and swiftest possible punishment to the accused in this crime’, ‘Immediate inquiry and suspension or any punitive action against all erring police administrative and even medical officers, who tried to manipulate the facts and evidence in this case’, ‘Setting up of adequate institutional mechanisms and guidelines so no other victim or their family need to the lost regarding our law and order, and suffer the same fate’.

The letter covers the act of negligence of U.P. Police of delaying in filing of FIR because of best reasons known to them while protecting accused and allowing them to roam around scout-free for 5 days. However, in Lalita Kumari v. Govt. of U.P. the bench ruled that “Section 154(1) CrPC is mandatory and the concerned officer is duty bound to register the case on basis of information disclosing commission of any cognizable offence.” Stated in letter.

As victim succumbed to her injuries on September 29, the body travelled through an ambulance and victim’s family in other vehicles but, family was dropped at their residence and took ambulance for cremation. Family alleged that they were beaten by police for resisting cremation and therefore locked themselves up in the house. Cremation took place at 2:45 a.m. against their consent. Letter reads, “It is from this point onwards that the actions of the police officials seem unfathomable and raise many questions which intertwine between our rule of law and our nation’s humanity. Barely had the victim’s family begun to process their loss, when actions of the UP police officials left one and all enraged.”

Delhi Women Commission (DWC) also wrote to Chief Justice and Judges of Supreme Court to take cognizance on the same, and on similar note a petition drawn by Advocate Praveen Kumar Yadav, filed by Sanjeev Malhotra in the Supreme Court praying for investigation in this Gang-rape case to be initiated by Central Bureau of Investigation or Special Investigation Team.
