LAWYERS CAN TAKE ACTION AGAINST LITIGANTS WHO HARASS THEM OVER COURT’S QUERY: MADRAS HC

New Delhi: In a recent ruling, the High Court of Madras stated that counsels can take legal action against litigants who harass them over queries raised by the court.

This observation was made by the division bench comprising of Chief Justice SV Gangapurwala and Justice PD Audikesavalu while hearing a Public Interest Litigation (PIL) filed by a final year law student.

The PIL, filed under Section 19(1) of the Maintenance and Welfare of Parents and Senior Citizens Act 2007, sought the establishment of government-run old age homes in every district of Tamil Nadu, highlighting the state's lack of such facilities.

During the previous hearing, the court sternly warned the petitioner that if the claims were found to be false, a Rs. 50,000 penalty would be imposed.

During the recent hearing, the counsel for the petitioner informed the bench that he had been harassed by the petitioner since the previous hearing. Following that, the lawyer expressed a desire to withdraw from the case. The court allowed the lawyer to withdraw and gave the petitioner time to hire another lawyer.
