Kerala Court To Media: No Reporting On Bishop Franco's Trial In Nun-Rape Case Without Prior Permission

The trail court of Kerala abstinent the electronic and print media from publishing any kind of news on the bishop and nun rape case.

The proceedings are happening in-camera and Franco Mukkal, a roman catholic church bishop is the prime accused in this case. The court has also stopped discussions on the evidences produced by the witnesses without prior permission of the court.

The reason court gave for restraining media from publishing anything related to the matter is that this will hamper the innocence of the accused if he is innocent and it will create a strong public estimation against the person facing the trail.

 Usually courts have seen that in these kind of matters people create opinions and any criminal trails should stay away from these pre-judging sources because they are a threat to fair trails,observed  by additional sessions judge I, G Gopalkumar

Subsequently court also invoked Section 372(3) of CRPC which enables the court to take such actions when trail is proceeding in- camera and section 372(2) enables that rape cases should be trailed in- camera and media and other sources should be restrained from it.
