Justice Pasha Comments Post-Retirement Raises Questions over Fairness of Collegium

Kerala High Court judge B. Kemal Pasha, during his farewell speech, made a few comments that have triggered a nationwide debate over the fairness of Collegium.

Post his retirement on May 24, Justice Pasha made revelations about the “discontent brewing in the apex of the state judicial set-up, over the recommendation of a few names of lawyers for appointment to the HC bench”.

According to sources, lawyers recommended by the High Court collegium – for elevation to the bench – were relatives of the incumbent judges.

While making such revelations, Justice Pasha in his first post-retirement interview said that “those suspecting interference in judiciary from outside cannot be blamed”.

Pasha also expressed his displeasure about the development at the HC saying, “Appointment of judges should not be like partition of assets in a family. Judges come and go, but the court will have to bear the loss. Judges should not be appointed like wealth-sharing in families. Any caste or religion cannot monopolize it. It's my impression that those under consideration now do not have the merit for the job.”

He further said that, some of the names considered for appointment as judges have no merit and to identify one had to rely on the HC directory.

However, the High Court recently rejected a plea asking to term the collegium recommendations as null and void. According to the petitioners claim, five lawyers proposed by the collegium were the kin of a few retired and sitting judges of the High Court and a judge of the Supreme Court.
