INX MEDIA CASE: Chidambaram’s surrender application dismissed by CBI Court


The Special CBI Judge Ajay Kumar Kuhar has dismissed the surrender application filed by P Chidambaram in the INX Media money laundering case registered against him by Enforcement Directorate (ED).


The former Union Minister is already lodged in judicial custody till September 19 in the INX Media corruption allegations case registered by the Central Bureau of Investigation (CBI) after he was arrested on August 21 by CBI from his jor bagh residence.


Thereafter, Chidambaram had moved an application before the Special Judge for surrendering before the court in the case registered by ED as both the agencies were inquisitive to arrest him and required his custodial interrogation during the investigation.


The ED was represented by Solicitor General Tushar Mehta while Chidambaram was represented by Senior Advocate Kapil Sibal.


ED contended that it did not want Chidambaram’s custodial interrogation as of now and they will inform the court as and when the need arises. Also, SG Tushar Mehta argued that the application filed by Chidambaram should be dismissed at the threshold as the accused cannot guide or dictate the manner in which investigation should be carried out by any agency.


Whereas, Kapil Sibal rebutted Solicitor General’s arguments stating that not requiring custodial interrogation by ED is an afterthought as the agency was willing to arrest Chidambaram on August 20 and the same has been put forth by the agency during the hearing of anticipatory bail plea of Chidambaram.


Sibal also argued that the accused always has a right to surrender before the Court and ED just wanted to prolong Chidambaram’s incarceration in Tihar Jail.


Chidambaram has been sent to judicial custody till September 19 by the Trial Court and he has filed Regular Bail application before the Delhi High Court in which notice was issued to CBI on Thursday and the matter will now be heard on September 23.
