Indu Malhotra to be appointed as SC judge

New Delhi:  Delhi based senior advocate Indu Malhotra, has been cleared for appointment to SC. Her name was recommended by collegium of Judges and was accepted by Centre. However the appointment of Chief Justice K M Joseph of Uttarakhand High Court to SC has been put on hold by Centre even when his name was recommended by collegium of Judges.

After Justice Leila Seth,Indu Malhotra 61,is the second Senior woman advocate to be elevated to SC. A Delhi University law graduate, Indu Malhotra has practised for thirty five in Delhi, mostly in top court. In 1988, she topped the tough advocate-on record test which allowed her to become part of the select group of lawyers who are eligible to file petitions in the SC. She has authored books such as ‘Laws on Industrial Disputes’ and also ‘Commentary on the Law and Practice of Arbitration in India’.

However in legal circles there is wide consternation on Justice Joseph being denied SC appointment.He is considered a man of impeccable integrity. It is being speculated that his heading the bench which quashed the imposition of President’s rule in Uttarakhand after the dismissal of the Congress government led by Harish Rawat has gone against him. However the government has given different reasons. As per the government,in terms of seniority he is lower down and there are other judges which are more senior to him.

Last word is yet to be heard in the matter and judiciary and Centre seems to be on the path of confrontation.
