Hon’ble Chief Justice Uday U. Lalit to hear plea seeking guidelines to curb custodial violence

A petition has been filed by People's Charioteer Organization pleading the honourable Supreme Court to outline rules and guidelines to stop custodial deaths, rape and violence in exercise of its intrinsic power under Article 142 of The Constitution.

The petitioners through their advocates have submitted that the custodial violence in itself demonstrates the loopholes in the criminal justice system and inability to maintain lawful protection against custodial abuse.

The appeal has been recorded in the wake of custodial deaths of Jeyaraj-Bennix custodial death case. The petitioner has submitted that there is an urgent need for institutional correctives under policing system of this country and there is an urgent need to frame strong laws curbing custodial violence in India to guarantee protection of right to life.

It is submitted that these incidents and happenings are absolute violation of fundamental rights guaranteed under article 14 and 21 of the constitution and there is an important need to frame proper guidelines for such incidents.

 The Organization has urged before the apex court to fill the loopholes and to frame effective and purposeful norms to prevent custodial violence. It has also sought the direction on the government to form an “Independent committee” comprising of members from relevant departments and ministries to look after the entire legal system and to find the inconsistency in the existing law.
