Government and Supreme Court in favour setting up regulatory body for legal profession

The Government of India  and Supreme Court are in favour of establishing a regulatory body to mind the ethics in the legal profession. The objective of this body is to improve the global position in the implementation of business contracts. 

According to a report published in Economic Times

In an effort of bringing major changes in the Indian legal profession, the Government of India and Supreme Court have suggested that there is a need to regulate the professional fees. 

“Regulatory framework of the legal profession needs a review. There is need to regulate professional fee and ethics which can be done by an independent body instead of elected body of the Bar,”. The meeting was attended by the top brass of the Prime Minister’s Office and secretaries from the ministries of finance, revenue and law and Niti Aayog. 

In a presentation by the Department of Justice highlighted that without an independent regulatory body country’s position across the globe has been affected adversely. As per World Bank Doing Business Report 2017 ‘India is ranked at 130 out of 190 countries in ease of doing business and was placed 172 for enforcing contracts, which measures the time and cost of resolving a commercial dispute and the quality of judicial processes.

In India the legal ethics are regulated by the bar councils. Various reports by the Law Commission were referred during the meeting. During the meeting it was recorded that the strikes by lawyers results in obstruction in administration of justice

It was emphasized that the legal aid must be provided to the poor. The Bar Council can introduce a feedback system to keep a check on the lawyers and their performance. For this an independent website can be set up to provide information and to redress grievances of litigants against violation of ethics.
