Fox News wins infringement case against media monitoring company

In a 3-0 ruling given by Manhattan Court against TVEyes, a media monitoring company, the Court held that the company caused harm to Fox News by airing content without its exclusive permission. The Court held that such an act caused revenue loss to Fox News. The Court said that by airing content of Fox News on its platform, TVEyes Corporation violated Copyright enjoyed by Fox News.

TVEyes records and indexes news content from more than 1400 TV and Radio channels. The service is frequently used by politicians, media members, investment banks and trial lawyers. 

It will be important to inform the reader here that District Court had earlier ruled in favour of TVEyes terming the running of information of the content made by Fox News on TVEyes platform as "fair use". But an appeal against the same was filed by Fox News and the higher court accepted the appeal and gave verdict in favour of Fox News. While delivering the verdict, the three judge bench stated that “TVEyes has failed to show that the product it offers to its clients can be justified as fair use.”
