Former Justices hit out at Supreme Court Collegium that changed picks for elevation

The Supreme Court Collegium has come under fire from four Retired Senior Judges for dropping names of two HC Chief Justices picked for elevation to the SC a month ago instead It has recommended 2 new names of Justice Mahesh Dineshwari and Justice Sanjiv Khanna.

Though the previous Collegium comprising of the Chief Justice of India, Justices Madan B. Lokur, A.K. Sikri, S.A. Bobde and N.V. Ramana had taken decisions, the present SC Collegium (minus Justice Lokur (who retired last month), plus Justice Arun Mishra), which met after re-opening of Court, decided to have a fresh look at the matter. The Collegium that met in December had taken decision to elevate Justice Pradeep Nandrajog, Chief Justice of Rajasthan High Court, and Justice Rajendra Menon, Chief Justice of Delhi High Court.

The SC Collegium’s move did not go down well with some of the former Justices of the SC who have expressed their displeasure.

Justice Chelameswar, who retired last year said that "This is exactly why I refused to attend the Collegium meetings in 2016. I was told by legal luminaries then that I should resign and then speak. Now, I have retired, so should I speak?"

Former CJI RM Lodha said that the Collegium is an institution and it must work as one. He further said that the decisions taken by a Collegium must be taken to their logical conclusion. 

SC Judge, Justice Sanjay Kishan Kaul, has reportedly written to CJI making clear his objection against sidelining of Justice Nandrajog. He is said to have opined that since Justice Nandrajog was the senior most among the judges in the zone of consideration, a wrong signal would go out if he was passed over.

Justice Khanna is 33rd in the combined seniority of High Court Judges on an all-India basis while Justice Dinesh Maheshwari had been superseded by Justice Ajay Rastogi once

 Former Delhi High Court Judge Kailash Gambhir has even written a letter to President Ram Nath Kovind saying the Collegium resolution to elevate Justice Sanjeev Khanna was ‘appalling and outrageous’.
