FIR filed against HC’s Lawyers for Forgery

An FIR was lodged on late Saturday evening against two lawyers of the Gujarat High Court for allegedly producing fake documents before the court relating to a plea challenging the minority status of a city-based school.

One of the two accused lawyers is the son of an HC judge and represents a constitutional body as a standing counsel.

Both of the accused lawyers have been booked under the IPC for offences including cheating that causes wrongful loss, criminal conspiracy, criminal breach of trust, forgery of court records, and forgery of documents and using of forged documents to cheat others.

As per the details of the case, when the accused lawyer first appeared as the standing counsel of the constitutional body during the hearing of the plea, his father recused himself from the hearing on June 13, 2017 by saying ‘Not Before Me’.

The case was then listed before another judge on November 16. During the second case hearing, another advocate appeared and produced before the court an NOC from the constitutional body.

The petitioner, who had challenged the minority status of the institution, however sensed something suspicious and filed an RTI application before the constitutional body to confirm the authenticity of the NOC.

The petitioner after receiving a reply from the constitutional body came to know that the signatures and seal of the commission for the NOC needed to appoint the second lawyer were fake. In fact, they were allegedly forged by the standing counsel, said the FIR.
