Failure to check overcharging of school fees: Kerala High Court

On Wednesday, 9th December, 2020, the state government had been questioned by Kerala High Court regarding plans which are made for issuing notifications directing all affiliated schools to collect fees which is proportional to their expenditure. Justice Devan Ramachandran was hearing the petition which was filed by a batch and in that petition the batch had challenged the excessive charging of fees by the schools in this pandemic situation.

In an interim order, the Court had asked for a reply from the government after being informed by Senior Government Leader Nisha Bose that a circular was released on 2nd December, 2020, directing all institutions, including CBSE and ICSE, to receive only expenses as fees for the academic year as previously indicated by the High Court.

According to the Counsel representing CBSE, the Board is not in a position to verify the statements of income and expenditure of the schools as per the previous direction of the High Court. On 20th November, 2020, the Board was directed by Kerala High Court to issue a notification by stating that all affiliated schools must not charge an extra fee which is more than the actual expenses of the schools in this current pandemic situation.

The Court has asked a reply from the government regarding the creation of a system to deal with concerns about overcharges of school fees during the pandemic. The petitioners were also directed to pay the tuition fees of the first term as per the earlier order of the High Court. The matter will be heard by the Court on 17th December, 2020.
