Existing Arrangements Of Hearing To Be Extended Till 16 Jan, 2021: Delhi HC

The High Court of Delhi has notified that considering the current pandemic situation in Delhi, the ongoing arrangement of hearings will continue till Jan 16, 2021.

An office order dated Mar 23, 2020 was initially directed by Delhi High Court particularly keeping in view the announced lockdown and request of Bar Association, holding the closure of functioning of High Court as well as Subordinate Courts thereto till Apr 04, 2020, which was further extended by Chief Justice of India till Apr 15, 2020 and the Administrative and General Supervision Committee suspended the functioning of the Courts till May 03, 2020.

However, in order to make up for the loss incurred by Courts and for maintaining the normalcy of its functioning, the courts had resolved to continue functioning for the entire month of June. In the last meeting, it was concluded that subject to the complete availability of public transport and the situation in Delhi remaining stable, a plan would be evolved for gradual opening of physical courts from 1st September. In this concern a Standard Operating Procedure (SOP) was soon accepted for the functioning of Delhi High Court and subordinate courts, which was presented to the full court along with the suggestions by judges of High Court along with the report submitted by the Delhi High Court Bar Association. The full court while taking note of the pandemic situation, approved the SOP presented to them with certain updates and had extended the suspended functioning of courts till Sep 30, 2020.

Only five benches were ordered to conduct physical hearings on rotational basis while the others were allowed to hear the matters through video conferencing.  Reviewing the physical hearing on Sep 10, 2020, the full court resolved to constitute a suitable number of benches with effect from Sep 15, 2020. It was announced on Oct 07, 2020 that the present system of hearing would continue till Nov 30, 2020.

 For the cases to be heard from of Dec 01, 2020 to Jan 16, 2021 the order reads “In view of the escalating situation of the pandemic of corona virus (2019-nCOV) in the NCT of Delhi, it is resolved that the present system of hearing the matters before this Court shall continue up to 16.01.2021. All the pending routine/non-urgent matters listed before this Court from 01.12.2020 to 16.01.2021 be adjourned”
