Elections to Bar Council of Kerala advanced by SC from 25 to 18March

Yesterday, The Supreme Court directed that the elections to the Bar Council of Kerala would be advanced from March 25 to March 18.

A Bench of Justices RK Agrawal and AM Sapre passed this direction in an application filed by certain advocates practicing in Kerala.

The advocates had submitted that the festival of Palm Sunday falls on March 25 which is a holiday in the State and a large number of Christian voters might not be able to cast their votes. They had, therefore, prayed for an advancement of elections to March 18.

The Supreme Court in its order noted the same.

“Learned counsel appearing for the applicants contended that the day of election though being Sunday, is a festival day celebrated in the State and therefore, it would not be possible for the majority of the voters to cast their vote. A request was made to pre-pone the date of election from 25.03.2018 to 18.03.2018. 8).”

It, therefore, allowed the request and advanced the election date to March 18.

“Considering the special facts and circumstances of the case, we pre-pone the date of election for Bar Council of Kerala from 25.03.2018 to 18.03.2018, however, rest of the election schedule, as finalized by the BCI, will remain the same.”

The applications filed by various others including Bar Council of Rajasthan and lawyers enrolled with Bar Council of Delhi, Bar Council of Andhra Pradesh and Bar Council of Maharashtra & Goa and Bar Council of Tamil Nadu were, however, rejected by the court.
