ECI'S ORDER REJECTING TEJ BAHADUR YADAV'S CANDIDATURE FOR ELECTIONS CHALLENGED IN SUPREME COURT

Tej Bahadur Yadav, ex Border Security Force Jawan, was dismissed from his services in the year 2017. It was found that he had made false complaints about the quality of food. He has filed a petition in the Supreme Court in which he alleges that he was not given enough time to produce certificate of his dismissal. Merely 17 hours time was granted to him for doing so. Another issue raised in the petition is that he was dismissed for the charge of indiscipline and not false complaint or not being loyal to the State. Therefore, he contends that his case doesn't fall under Section 9 of the 1951 Act as decided by the Returning Officer. So certificate by the Election Commission under section 33 (3) of the Act of 1951 is not required to be shown and his candidature for the elections should not have been rejected.

He defended his move of directly approaching the Apex Court in the following words:

"in view of the abject failure of the Election Commission in exercising its constitutional power to ensure free and fair election and also total arbitrariness and malafide of the Returning Officer in disqualifying the Petitioner from contesting the Lok Sabha election".
