District judge confines daughter: Patna HC orders SSP to Produce Judge’s Daughter in Court

The Patna High Court on Saturday took ‘suo motu cognizance’ of a media report published on June 22 in the website 'Bar & Bench' on the alleged confinement of a CNLU grad by her father, a District Judge in Bihar.

The case was listed for hearing before a division bench comprising of Justices Rajendra Menon and Justice Rajeev Ranjan Prasad today.

The HC bench has ordered the Patna SSP to produce the judge’s daughter in the court on Tuesday.

Chief Justice Rajendra Menon today asked the SSP to form a special team, comprising of two lady officials to bring the CNLU graduate in the chief justice’s chamber tomorrow.

Case background:

According to the ‘Bar & Bench’ report, Yashaswini, a 24 year-old Law Graduate from Chanakya National Law University (CNLU) in Patna, has been allegedly put under house arrest by her father, Khagaria District and Sessions Judge Subhash Chandra Chaurasia over her affair with Advocate Siddharth Bansal.

Siddharth is a Supreme Court Lawyer in New Delhi.

Going by the report, Yashaswini and Siddharth met for the first time in 2012 at the Saket Court complex. Yashaswini was due to appear for Delhi Judicial Services Exam on May 6 this year. However, when her mother came to know about the affair, she took Yashaswini back to Khagaria without letting her take the exam.

On reaching Khagaria on May 8, the report said, Yashaswini was thrashed by her parents and two calls were made to Siddharth, in which he could hear Yashaswini’s cries over the phone and getting thrashed.

Siddharth then approached the National Commission for Women (NCW) on Yashaswini’s behalf, but there was little that could be done since Yashaswini was under house arrest. Even Police Authorities have failed to act.

Bar & Bench also published a statement penned by Yashaswini, which states:

“As per the Supreme Court judgement, I have the right to choose my life partner and also…to choose [the] occupation which I want to pursue. I don’t want to take further action against my parents, which can harm their reputation. I want justice and [to] avail my fundamental rights and if it will not be possible then yes, I’m ready to fight for my rights even against my parents. It’s a humble request…please help me out to get justice.”
