Denied Job by CISF, Maharashtra Man with tattoo gets relief from Bombay HC

On Thursday, the High Court of Bombay came to the rescue of a Solapur resident, who was denied a job by the CISF on account of a tattoo.

Shridhar Pakhare had applied for a job of constable-cum-driver with the CISF. Despite clearing the requisite test and medical examination for the post, however, he was disqualified because of a tattoo on his right forearm. That’s because, according to CISF rules, a person with a tattoo cannot qualify for the armed forces.

Pakhare then filed a petition in the Bombay HC against the CISF’s decision holding him unfit for the post of constable-cum-driver.

Pakhare said he made the efforts to remove the tattoo surgically, but failed to have it removed completely. He also argued that “as the Army makes an exception for those who have tattoos depicting religious symbols, the CISF be directed to do the same.”

He also raised questions over recent CISF circular inviting applications – for the post of senior inspector – that stated religious symbols were permissible if they're small in size.

On hearing the petition, the two judge bench consisting of justices R M Borde and Rajesh Ketkar held that tattoo would not interfere with the petitioner's official duties. The bench further said that Pakhare had met all other eligibility criteria, and so, CISF must make an exception to their rules for him.  

The HC bench also held that since the petitioner’s tattoo was of religious symbol, his religious sentiments must be respected.
