Delhi HC to hear AAP’s plea against the disqualification of its 20 MLA today

The Delhi High Court today is set to hear AAP’s appeal against the disqualification of its MLAs for holding “offices of profit”.

Interestingly, the hearing comes a day after President Ram Nath Kovind gave his nod to the Election Commission’s (EC) recommendation to disqualify the 20 AAP MLAs.

The BJP hailed the president's decision and called for Kejriwal's resignation on moral grounds. The Congress, however, alleged that both the BJP and the AAP had struck a deal that caused the EC to delay the disqualification recommendation by a month.

AAP convenor and Delhi CM Arvind Kejriwal criticized the EC, calling its decision to be an "extremely unconstitutional, unethical and biased decision."

What’s more, while addressing a gathering in Najafgarh, the CM accused the BJP of orchestrating the entire matter to harass AAP and its members. He said, “They (BJP-led Centre) have tremendously victimised us by imposing fake cases on our MLAs. They conducted CBI raids on me and didn't get anything and today they declared 20 of our MLAs disqualified."

In yet another interesting twist in the case, BJP leaders Yashwant Sinha and Shatrughan Sinha supported Aam Aadmi Party in the matter.

Yashwant Sinha tweeted, "President's order disqualifying the 20 AAP MLAs is complete miscarriage of natural justice. No hearing, no waiting for High Court's order. It is Tughluqshahi of the worst order."

The list of the 20 disqualified AAP MLAs include Alka Lamba, Adarsh Shastri, Sanjeev Jha, Rajesh Gupta, Kailash Gehlot, Vijendra Garg, Praveen Kumar, Sharad Kumar, Madan Lal Khufiya, Shiv Charan Goyal, Sarita Singh, Naresh Yadav, Rajesh Rishi, Anil Kumar, Som Dutt, Avtar Singh, Sukhvir Singh Dala, Manoj Kumar, Nitin Tyagi and Jarnail Singh.

If AAP fails to get reprieve from the courts, Delhi will have by poll for the 20 seats.
