Delhi HC Refuses to Interfere with Rising Fuel Prices Issue, says ‘It’s an Economic Policy Decision’

Daily revision of fuel prices was an “economic policy decision” taken by the central government and the courts must not interfere with it, a bench of Delhi HC comprising Chief Justice Rajendra Menon and Justice VK Rao said today.

The bench observation came while hearing a plea filed by a Delhi resident Puja Mahajan against the daily changes in the petrol and diesel prices.

In her plea, the petitioner also demanded that directions be given the Centre to fix a “fair price” for petroleum products by treating them as “essential commodities”.

Mahajan in her plea also alleged that the central government had “indirectly given implied consent” to oil marketing companies (OMCs) to raise petrol and diesel prices at their own “whims and fancies”.

However, the HC bench made it clear that it was not inclined to interfere with the Centre’s decision, saying “there are larger economic issues” involved and the courts must remain away from it.

Government may do it (fix a fair price). We cannot issue a mandamus (direction) to them to do it,” the bench further said.

Advocate A Maitri, appearing for the petitioner, then told the court that Ms Mahajan’s representation to the central government on the issue has not yet been decided, as a similar plea filed by the petitioner was disposed of by the court – asking the Centre to treat it as a representation and take a decision.

However, since the central government had not taken a decision to date on the petitioner’s representation, she filed the present petition, the plea reads.

The bench, thereafter, directed the Centre to decide the representation within four weeks and scheduled the matter for further hearing on November 16.
