Court proceedings can be live-streamed, rules Supreme Court

Supreme Court today allowed live-streaming of court proceedings, starting from the country’s top court, saying “sunlight is the best disinfectant”.

A three-judge bench comprising Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud said that live-streaming of court proceedings will effectuate the “public right to know” and bring in more transparency in judicial proceedings.

The Bench further said that the appropriate rules for live streaming – balancing right of public and protecting dignity of litigant – will be framed soon under Article 145 of the Constitution of India.

Case Background:

A bench of Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud had reserved its verdict in the matter on 24 August, saying that it wanted to implement the concept of “open court” in order to decongest the courtrooms.

The top court’s decision came on a clutch of petitions, including those filed by senior lawyer Indira Jaisingh, law student Snehil Tripathi and an NGO Centre for ‘Accountability and Systemic Change’.

We don't perceive any difficulty in live streaming. Let us first start with it and see how it goes. We are just on a pilot project. We are not ruling out anything and will improve with time. We cannot have everything together,” the top court had observed earlier.
