Contempt Petition Filed Against Justice Ahsanuddin Amanullah of the Patna High Court

Contempt petition has been filed against Justice Ahsanuddin Amanullah of the Patna High Court for using objectionable and derogatory remarks against the advocate appearing before his court.

Advocate Alka Verma filed the contempt petition, appealing that the Patna High Court takes suo motu cognizance of the alleged contempt perpetrated by Justice Amanullah.

In her petition, Verma alleges that while disposing of a writ petition in which she had appeared Justice Amanullah resorted to humiliating her by making “some very highly objectionable and derogatory statements in a very offensive tone”.

Moreover, in her petition, the advocate also claimed that Justice Amanullah made unwarranted comments on how she was empaneled, and “hankering for bills”.

Pairavi kar kar ke panel main aate hai” (One gets into panels through references) and “Sirf bill banane me interest hai” (One is only interested in getting one’s fee)”, she claimed the judge said in open court.

She then quoted a speech made by the CJI Dipak Misra at a farewell function, and said that it is the duty of the judges to show respect to the lawyers, regardless of their age or status.

She even asserted that a judge cannot make personal remarks and use harsh words in open court, which could damage the reputation of a lawyer in the eyes of his colleagues and litigants.

That the Hon’ble Mr. Justice Ahsanuddin Amanullah by aforesaid act of utterances of uncharitable words towards the “officer of the court” in the open court, before the client and juniors and other learned advocates present in the court has not only violated the oath but also scandalized the Hon’ble Court”, the application reads.

Therefore, it has been prayed by the applicant that the Patna High Court takes suo motu cognizance of the issue.

I don't think such instances would recur if there is live recording of the proceedings as suggested by Adv Indira Jaisingh !

Indeed it is very shameful on the part of a hon'ble Justice for using objectionable and derogatory remarks against female advocate I think we judges could deliver judgements just because some qualified and talented (having vast experiences then judges) advocates are for our help one should always keep in mind about the dignity and status of women before uttering any word for her
