Consider Death Penalty for Convicts in Corruption Cases: HC to Central Govt

On 2nd November, 2020, the Central Government was recommended by the Madras High Court, to consider death penalty for the convicts who are guilty of corruption cases. According to the Advocate General, The Prevention of Corruption Act is a Central Act, passed by the Central Government in 1947, followed by a number of changes, with the most recent amendment in 2018, providing for specific processes to be followed along with fines and penalties.

The Court was of the view that, in recent days, corruption cases has increased to a great extent and for that general public are facing problems and they are compelled to accept corruption. In most of the days, news can be found that many government officials are caught red handed while taking bribes from general public.

The Court was also of the view that, now a days the government officials are not taking the punishments seriously and hence, the corruption cases are increasing. To stop this, some strict punishments must be implemented. The Central Government must consider some strict punishments such as death penalty.

One of the recommendations adopted by the Central Government is the delegation of powers and responsibility to every Government servant, at every point and at every level. This particular view of the Court was given in the case of A.P. Suryaprakasam v. The State of Tamil Nadu & Ors.(W.P [MD] No.14481 of 2020).
