CJI headed SC bench to hear plea for probe into Judge Loya’s Death today

CJI Dipak Misra headed SC bench will hear 2 petitions seeking an independent investigation into the death of special CBI judge justice Loya today. Other than the Chief Justice of India, the bench will comprise of Justices AM Khanwilkar and DY Chandrachud.

According to reports, activist Tehseen Poonavala and Maharashtra-based journalist B.R. Lone had filed independent pleas demanding a fair probe into Justice Loya’s death.

Judge Loya died in Nagpur on December 1, 2014, while he was presiding over the trial of BJP Chief Amit Shah for the allegedly fake encounter of Sohrabuddin Sheikh and his wife Kauser Bi in 2005. Shah was, however, later discharged in the case the same month.

Earlier, the petitions were heard by a bench of Justices Arun Mishra and MM Shantanagoudar who ordered that “the Loya case be put up before an appropriate bench.” This triggered speculation that the judges had rescued themselves from hearing the case.

However, the order passed by a bench headed by Mishra did not mention the next date of hearing. Lone’s advocate Anita Shenoy's, said she went to the Chief Justice's court to apprise him about the last order in the case and seek a date for hearing.

In the SC a roster system is followed to mark cases to specific benches that sit in the combination of two judges. Roster is notified by the SC registry after the CJI approves it. However, the roster is not made public and even lawyers remain unaware of the same.

When a “sensitive matter” or PIL is filed the SC registry brings it to the notice of the Chief Justice of India, who then decides on who will hear it.
