CJI Appointment row: Don’t doubt government intentions, says Law Minister

The government’s intention should not be doubted over the appointment of the next Chief Justice of India (CJI), the Union Law Minister Ravi Shankar Prasad said on Monday.

The Law Minister further added that the Centre will discuss about the selection of the next CJI as per the recommendation of the current CJI Dipak Misra.

Prasad was speaking at a press conference – on the achievements of his ministry in the last four years – when he was asked whether the government will follow the laid-down convention of appointing Justice Ranjan Gogoi as the next Chief Justice after the retirement of the CJI Dipak Misra on October 2.

Responding to the question, Prasad reportedly said, “Let me first say that this question about the appointment (of Justice Gogoi as CJI) is hypothetical. There is a convention in place. The sitting CJI has to forward the name of his successor. Let that name come first…There is no reason to doubt our intentions.”

Justice Ranjan Gogoi is the second senior-most judge in the SC and is lined up to be the next Chief Justice of India.

However, doubts have been raised over the Gogoi’s elevation as the next CJI following the unprecedented press conference that was held in January this year by the four senior judges of the SC including Justice Gogoi. During the press conference, the judges had criticised Justice Misra over several issues, particularly the manner of allocation of cases in the top court.   

But going by the Memorandum of Procedure (MoP) – the guiding document for judicial appointments – states: “Appointment to the office of the CJI should be of the senior-most judge of the SC considered fit to hold the office.”

The document further states, "Whenever there is any doubt about the fitness of the senior-most Judge to hold the office of the Chief Justice of India, consultation with other Judges...would be made for appointment of the next Chief Justice of India.”
