Centre Returns Collegium Recommendation to Elevate Justice Aniruddha Bose as Chief Justice of Delhi HC

After more than six months since the Supreme Court’s Collegium recommended the appointment of Justice Aniruddha Bose as the Chief Justice of Delhi HC, the Central government has returned the recommendation for reconsideration. 

The Centre returned the recommendation of Justice Aniruddha Bose, a senior puisne Judge of Calcutta HC, for reconsideration to the Collegium, sources said.

This is not the first time that the Centre had returned the proposed name for elevation to the SC Collegium for reconsideration. In fact, both parties have been at loggerheads over the appointment of judges to the higher judiciary several times.

In the last disagreement between the Centre and SC Collegium, the former had returned the name of Chief Justice of Uttarakhand HC Justice K M Joseph, who was recommended to be elevated to the top court. The government had cited seniority and regional representation in justification for its stand on returning Justice Joseph’s name.

Law Ministry sources said, in Justice Bose’s case, the Centre returned his name, saying that “he does not command any experience as a Chief Justice to head a prominent High Court like Delhi”.

Meanwhile, the Delhi HC has been functioning with an acting Chief Justice Gita Mittal for more than a year now, since Justice G Rohini’s retirement in April 2017.
