Centre (finally) appoints Justice Ramendra Jain as Permanent Judge of Punjab & Haryana High Court

The Centre on Monday finally approved the appointment of Justice Ramendra Jain as a permanent judge of the Punjab and Haryana High Court, months after it refused to accept SC Collegium proposals to this effect.

The Centre’s decision came in the wake of retirement of two judges of the Punjab and Haryana HC this week.

The Central Government has created a stir in April this year, as it unilaterally altered the Collegium’s recommendation and extended Justice Jain term as an Additional judge of the Court to six months instead of appointing him as a permanent judge.

Justice Jain has been recommended to be appointed as a permanent judge of the Punjab and Haryana HC on March 26, earlier this year. However, after the Collegium failed to yield any constructive response regarding the recommendation, it reiterated its recommendation for the appointment of Justice Jain.

The Collegium had, in fact, recorded special reasons for retaining Justice Jain at the Punjab and Haryana High Court.

 “We do not see any good ground for linking the proposal of transfer of Mr. Justice Ramendra Jain with the proposal for his appointment as Permanent Judge and even for revisiting, at this crucial juncture, the above-referred decision dated 26th March, 2018 for his appointment as Permanent Judge of the Punjab & Haryana High Court,” the Collegium observed.

But despite the Collegium’s observation, the Centre chose not to agree to the Collegium’s proposal and instead notified the extension of the Additional Judge for another six months.

However, with Justice Jain term of extension drawing to an end, the Central Government finally notified the appointment of Justice Jain as a permanent judge of the Punjab and Haryana HC.

The notification states:

In exercise of the powers conferred by clause (1) of Article 217 of the Constitution of India, the President is pleased to appoint Shri Justice Ramendra Jain, Additional Judge of the Punjab & Haryana High Court, to be a judge of the Punjab & Haryana High Court with effect from the date he assumes charge of his office.”
