CCTV footage an additional tool of Evidence, not exclusive medium to prove Offence: Delhi High Court

Delhi High Court while rejecting a bail application stated that, the CCTV footage must be considered as an additional footage and not an exclusive medium to prove any offence. This particular bail petition was filed by an accused who was charged of murder and other serious allegations in connection to the North East Delhi Violence.

Additional Session Judge was hearing the plea and was of the view that, in absence of any CCTV footage it should not be held that the accused is not guilty. Missing CCTV footage also does not implicate that an incident never happened. According to the Court, CCTV footage is an additional means of proof and not an exclusive means of proving an offence. The Court was also of the view that, according to the role of the accused/applicant in this particular case, the bail application cannot be granted. Hence, the Court had dismissed the bail application.

The lawyer on behalf of the accused argued that, the accused is suffering from stroke and also other diseases in relation to kidney, liver and throat. The lawyer also argued that, there was no CCTV footage and all the allegations against the accused are false.

Additional Public Prosecutor strongly opposed the bail application and stated that, when police officers attempted to interfere to monitor the incident, a hostile crowd assaulted police officers as well, resulting in injury to many police officers. A passerby was badly injured by the gunshot and another passerby died on the spot due to the gunshot.

Approximately 53 people were killed and hundreds of people were injured due to the violence which took place at North East Delhi between the groups supporting and opposing the Citizenship Amendment Act.
