Can’t Presume Couple Found Inside Locked Room Are in Immoral Relationship, Rules Madras High Court

Madras High Court was hearing a termination plea of a police constable who was found locked inside a room with a woman constable. Justice R. Suresh Kumar was of the view that, merely a man and woman were found inside a locked room, it does not prove that the man and the woman were involved in an immoral relationship. The Court had noted that, the male police constable was issued a termination notice only on the ground of moral turpitude as the police constable was found locked inside a room with a woman constable.

The Court had found no reason to initiate disciplinary action against the police constable just because the accused was found in a compromise position with a woman constable in a locked room. According to the accused police constable K. Sravana Babu, the woman constable had come to his house only because she was searching for her key. However, when neighbours were knocking at the door at that time the door was locked and no one was there to open the door hence, the neighbours thought that the accused constable and the woman constable were engaged in some immoral activity.

The Court had noted that, there was no clear evidence and no eyewitness to prove that the accused constable and the woman constable were found in a compromise position. In 2019, in a case, the Madras High Court had held that, occupation of hotel rooms by unmarried couples will not constitute a criminal offence because they are in a live-in relationship.
