Can’t be evicted from my flat, says retired Calcutta HC Judge CS Karnan

Former judge of the Calcutta High Court, CS Karnan, has told the state housing department and the Registrar General of the HC that he can't be evicted from his Kolkata flat till his order against eight Supreme Court judges is not executed.

Justice Karnan said that he wants to continue to stay at his flat at the Rosedale Complex in New Town, Kolkata as it also served as his “make-shift-court” – from where he issued the order against the SC judges.

The new development over Justice Karnan’s Rosedale complex flat started when the housing department sent a letter to the judicial department secretary last month.

In the letter, the housing department has mentioned that the flat meant for a sitting judge of the Calcutta HC is still occupied by the retired judge, and thus it needs to be vacated.

Following this, the High court’s registrar general sent a letter to Justice Karnan.

When contacted, Justice Karnan said, “I have sent a reply to the state housing department and the Calcutta High Court’s registrar general. I have also sent copies to the International Court of Justice, Netherlands, and the United Nations Security Council.”

In the letter the retired judge wrote that he was aware that the chief engineer of the housing department sent an eviction notice.

The reason assigned by the engineer-in-chief is the Rosedale Development Pvt Ltd wants to sell the said property occupied by me,” Justice Karnan wrote in the letter.

Explaining his inability to vacate the flat, the retired judge said,

Now, the tenanted property serves as my residence and make-shift court. My occupation at the said site is of paramount importance as valid order is pending for execution wherein the law will surely catch up with the misdemeanors.”

Story so far:

Justice Karnan in May last year has charged eight SC judges, including the then chief justice J S Khehar and six other judges, under the SC/ST Prevention of Atrocities Act, 1989 and its Amendment Act of 2015. He had sentenced the accused judges to five years in jail.

The Supreme Court then sentenced Karnan to six months jail on charges of contempt of court, on May 9 last year.
