Bombay HC Directs Police To File A Reply On A Contempt Plea Against Reinstatement Of 4 Policemen Suspended In Khwaja Yunus Custodial Death Case

The Bombay Police has been asked to give a reply to the High Court of Bombay regarding a contempt plea which was issued against the replacement of four police men who are facing trial in Khwaja Yunus custodial death case.

The plea was filed by the mother of Khwaja Yunus. Yunus used to work as an engineer in Dubai and on December 25, 2002, he was arrested along with three others by Mumbai Police under Prevention of Terrorism Act, 2002 and the allegation depicted that Yunus along with three others were involved in a bombing which took place in Ghatkopar in the same year.

The police interrogated the four accused and after that Yunus was last seen on January 6, 2003. Yunus was brutally tortured but according to the police report he had escaped from custody.

The mother of Khwaja Yunus was asking for a dispersion on a contempt notice against the city police chief and also the principle secretary of Home Department as they have violated an order which was passed by the High Court in the year 2004 in which the Court directed the State Government to suspend and to initiate an inquiry against the four police men. 

After a petition was filed on behalf of the Yunus family, an investigation was ordered and the CID came to a conclusion that Yunus had not escaped detention, but had been killed.

Hence the four police men are facing trial on charges of murder and also destruction of evidence. A reply has to be filed by the police within 2 weeks.
