BJP Leader Swami Chinmayanand denied Bail by UP Court in the alleged Rape Case


The Chief Judicial Magistrate of Shahjahanpur District in Uttar Pradesh on Monday, rejected the bail application moved by BJP Leader Swami Chinmayanand who is presently under police custody for being accused of raping and sexually harassing a female law student.


The Court rejected the bail application on the ground of moving the same before the concerned Sessions Court, as reported by the Counsel for Chinmayanand.


The Court has also rejected the bail applications of other three men namely Sanjay, Sachin and Vikram on similar grounds. They had been arrested by the SIT on allegations of Extortion as leveled by the Counsel for Chinmayanand. As per reports, the mobile phone of Chinmayanand’s lawyer upon which the alleged extortion messages were received, has also been sent for forensic examination.


Swami Chinmayanand, a former Union Minister in Vajpayee Govt., was arrested from his ashram by the SIT on Friday and was sent to 14 days judicial custody. He verbally admitted the allegations of sexually exploiting and harassing the 22-year-old victim, however, neither agreed to charges of rape nor denied them.


As reported by the PTI, Chinmayanand was also admitted to a Lucknow Hospital on Monday after he informed police and jail authorities of certain cardiac problems.


The former BJP MP has been charged with Section 376C (Sexual Intercourse by a person in authority) instead of Section 376 (Rape) by the investigators while the victim and her family have been pressing the SIT to charge the accused with Section 376 also when sufficient proofs have been furnished by them against Chinmayanand.


Apart from section 376C, Swami Chinmayanand has also been charged with sections 342 (wrongful confinement), 354D (Stalking) and 506 (Criminal Intimidation) under the Indian Penal Code, 1860.
