Bihar Shelter Home: Supreme Court Expresses Concern over Increasing Incidents of Rape in the Country

The Supreme Court on Tuesday expressed serious concern over the increasing incidents of rape in the country, and pulled up the Bihar government for backing the Muzaffarpur shelter home.

A bench of Justices M B Lokur, Deepak Gupta and K M Joseph lashed out at the Nitish Kumar-led government for funding the NGO which ran the Muzaffarpur shelter home where girls were allegedly raped and sexually abused.

The money is being given without even verifying the credentials of the organization. All this means is that people are paying taxes and people’s money are being used for such activities. Can you imagine this?” the bench said.

The bench then referred to the National Crime Records Bureau (NCRB) data and said that “every six hours, a woman is raped in India”, and 38,947 women have been reported to be raped in India in 2016 alone.

What is to be done? Girls and women are getting raped left, right and centre,” the bench further said.

Advocate Aparna Bhat, who was appointed as amicus curiae in the matter, told the SC bench that so far no compensation has been paid to the alleged sexual assault victims of the Muzaffarpur shelter home.

The advocate also said that 41 girls, who was allegedly raped at the shelter home in Muzaffarpur, have been rescued but one was still “missing”.

During the hearing, Tata Institute of Social Sciences (TISS) which has conducted an audit of state-run shelter homes, told the court that out of 110 such institutions in Bihar, “grave concerns” have been raised about 15.

At this point, the Bihar government told the bench that 9 cases of sexual abuse have already been lodged involving these 15 institutions run by various NGOs.

The SC will resume hearing the matter at 2 PM.      

Case Background:

The horrific sexual exploitation of 34 minor girls in a shelter home in Bihar's Muzaffarpur district was first highlighted in an audit report submitted by TISS to the state’s social welfare department in April.

Following this, an FIR was lodged against 11 people, including Brajesh Thakur, the chief of the state-funded NGO. Besides Thakur, women staff members of the shelter home were among those who were arrested by the police in connection with the case.

Sexual abuse of 34 inmates were confirmed out of 42 girls in their medical examination, however, two other girls were unwell and are yet to undergo medical tests.

The NGO running the Muzaffarpur shelter home was blacklisted and the girls were shifted to shelter homes in Patna and Madhubani.
