Bar Council of Gujarat Resolves to Permit Needy Advocates to Do Alternative Jobs/ Business

In India there are many people who have lost their jobs and become unemployed due to lockdown situation of Covid-19 pandemic. Approximately over 75000 advocates in India are facing difficulties in finance and other factors due to present lockdown situation and for that reason it is necessary for many advocates to take up any alternative job or business in order to meet their ends.

According to Section 35 of Advocates Act, 1961 no license to practice will be given to any advocate if he/she is employed in any other job, business or profession. But in this lockdown situation due to Covid-19 there are many advocates who are not earning sufficient income, and hence facing difficulties in day to day life. To control this situation The Gujarat Bar Council has resolved that needy lawyers, who are struggling to meet ends due to the current lockdown situation, can take up alternative jobs / business until the end of this year.

In the resolution it states that not all but only those lawyers who are facing difficulties in handling the responsibilities of their families can get benefit from this exemption.

The resolution states that “In a meeting conducted on Sunday, the financial situation for more than 75000 lawyers during the last three months has been difficult and many of them are not able to bear their family responsibilities. So it has been resolved that the needy lawyers having Sanad, keeping the dignity of the profession in mind may take up any other job/business for maintaining financial stability and bearing their family responsibilities. Such lawyers will be exempted from section 35 of Advocates Act till December 31, 2020.”

The Council has also relinquished the late payment charges of Rs 250/- for extension of the Advocates Welfare Fund which was due from 1st of September, 2019. The Council has also made a resolution for taking strict actions against those advocates who write or daft against the Bar Council in any social networking sites.

The resolution will come into force after it has been accepted by the Bar Council of India.
