Authorities Cannot Allow a Person to Continue on Fixed Pay or Daily Wage for Three Decades: Allahabad HC

The petitioner of this case has been an employee of the District Development Office, Jaunpur since the year 1992. He worked as an electrician and his other works included operating the lifts and generators as well. He used to get paid after his work was taken in record from time to time.

The petitioner submitted that his work or employment should get regularised and he should be given the post of Class IV employee but the authorities have denied and rejected this as per the rules.

Justice Ashwini Kumar Mishra of the High Court of Allahabad observed that petitioner has fulfilled all the regulations under the Rules of 2001 but still was not granted with regularised employment.

The State argued that the petitioner was an employee under time-bound scheme and hence he was not eligible for regularised employment. The Court rejected this particular statement of the State Government.

The Court stated that no authority has the right to make a person work for fixed wages for more than three decades without regularising his employment. The writ petition was accepted by the Court and the Court ordered that the State to regularise the petitioner’s employment.
